In the following sections, we provide you with details of how we handle your personal data. Please note that the information below may be checked and amended from time to time. We therefore recommend that you review this privacy policy regularly. When you visit our website, your personal data is collected and used by us within the scope and for the purposes set out below:

SCOPE AND PURPOSE OF THE COLLECTION, PROCESSING AND USE OF PERSONAL DATA

The legal basis for processing your data for this purpose is the fulfilment of a contract pursuant to Art. 6 para. 1 lit. b GDPR and lies in our legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR. Display-Marketing

For our display campaigns, we also use the technology of Sizmek Inc. 401 Park Avenue S, 10016 New York City / USA ("Sizmek"), which enables us to present you relevant and targeted advertising material and ads based on your interests and usage patterns. In addition, Sizmek also provides access to standard metrics such as click-through rates, clicks, impressions etc. to measure the success of our advertising measures. For this purpose, cookies and similar technologies (e.g. pixels and statistical device identifiers) are used on the device with which you visit our website in order to analyse and evaluate your usage behaviour and interaction with advertisements. Cookies and other technologies do not store any personal data, you cannot be personally identified by us at any time. The data collected includes non-personal, usage-related data that does not allow us to make any conclusions about your person. For further information on data protection and the settings you can make in this regard, see http:/www.sizmek.com/privacy-policy/optedout/. We base this data processing on Art. 6 para. 1 lit. f GDPR. This permission allows the processing of personal data within the scope of our "legitimate interest". Our legitimate interest lies in the direct marketing, the analysis of the use of our advertisements and the improvement of our products and services. You can object to this data processing and the use of Sizmek by using the Opt-Out Tool provided under http:/www.sizmek.com/privacy-policy/optedout/ at any time. Follow the instructions described in this link, depending on whether you visit our website via a mobile device (e.g. mobile phone, tablet) or another device (e.g. PC).

Use of your data for marketing purposes

In order to provide you with personalised services and information on our website (on-site targeting), we use and analyse the personal data mentioned in the preceding sections. So-called cookies may also be used during the corresponding processing (see "Cookies" below). The analysis of your user behaviour can lead to the creation of a so-called usage profile. The usage data is combined only with pseudonyms, but never with non-pseudonymised personal data. To enable personalized marketing in social networks (see "Social Media functionalities" below), we include so-called remarketing pixels from Facebook and Twitter on the website (see "Tracking Tools" below). If you have an account with a social network that is linked to this website and are logged in at the time you visit the website, this pixel links the website visit to your account. In order to prevent such linking you have to log out of your account before visiting the website. Further settings regarding advertising can be made in the respective social networks in your user profile. The creation of pseudonymised user profiles for advertising and analysis purposes is based on Art. 6 para. 1 lit. f GDPR. This applies to all data processing operations listed in this section. This permission allows the processing of personal data within the scope of our "legitimate interest". Our legitimate interest lies in the direct marketing, the analysis of the use of our advertisements and the improvement of our products and services.

Storage of your personal data in the Bucherer CRM system

The personal data mentioned in the sections above is centrally stored and processed in the Bucherer CRM system. The data in the central CRM system is analysed by us for advertising purposes, in particular in order to offer you personalised services or product information. We also analyse the data in the CRM system in order to improve our products and services. User profiles relating to you may arise while this data is being analysed. By using the features of the website, you agree to the storage of your personal data in our CRM system and analysis of it for marketing purposes. You agree that user profiles relating to you may arise. This consent constitutes our legal basis for processing your personal data within the meaning of Art. 6 para. 1 lit. a GDPR. You are entitled to object to the analysis of your personal data for marketing purposes and the formation of user profiles at any time (see ‘Contact’ below).

Forwarding of data to third parties

We pass on your personal data only if you have expressly given your consent, if a corresponding legal obligation exists or if it is necessary for the enforcement of our rights, in particular to enforce claims arising from the contractual relationship. We also pass on your data to third parties if this is required for use of the website and the execution of the contract, in particular the processing of your orders, the processing of your purchases, the delivery and payment of your ordered products, the provision of services ordered and analysis of your user behaviour. In particular, we may pass on your data to third parties when you purchase a third-party branded product, if necessary for the execution of the sales contract and/or for after-sales services. Use of the data passed on for this purpose by third parties is restricted strictly to the purposes set out above. Various third-party service providers are explicitly mentioned in this privacy policy (e.g. in the sections ‘Using the chat feature’, ‘Tracking tools’ and ‘Social plug-ins’). A further service provider to whom personal data may be forwarded and who has or may have access to your personal data is our web designer, the company Paul Lewis Creative Ltd., Summit House, 170 Finchley Road, London, NW3 6BP. Further we point out that our parent company, Bucherer AG, Langensandstrasse 27, 6005 Lucerne, provides certain services on our behalf, e.g. chatting for us or organising our customer service. Finally, when you use your credit card to make payments in the online shop, we pass your credit card information on to your credit card issuer and to the credit card acquirer. If you opt to make a payment using your credit card, you will be prompted to enter all the necessary information each time. For the processing of your credit card information by these third parties, we ask that you also read the general terms and conditions and privacy policy of your credit card issuer.

Forwarding of personal data abroad

We are entitled to pass your data on to third-party companies abroad if this is necessary in connection with the processing of your queries, the provision of services or marketing campaigns. These third-party companies are obliged to protect the privacy of users to the same extent as the provider itself. If the standard of data protection in a country is deemed to be unacceptable in respect of the EU General Data Protection Regulation, we shall use a contract to ensure that your personal data is protected at all times in accordance with the EU General Data Protection Regulation. Various third party service providers and their registered offices are mentioned in the previous section (‘Forwarding of data to third parties’). The website is hosted on a dedicated server belonging to Wirehive, 23-24 Hercules Way, Farnborough GU14 6UU, UK. However, certain third-party service providers mentioned in this privacy policy have their registered office in the US (see ‘Use of the chat feature’, ‘Tracking tools’ and ‘Social plug-ins’). Further explanation on data forwarding to the US can be found under ‘Tracking’.

Right to information, deletion and correction

You can request information about the personal data stored relating to you at any time. Requests for information must be submitted in writing together with proof of your identity. Similarly, you are also free to request at any time that stored data relating to you is deleted or corrected. In addition, you have the right to reclaim from us the data that you have provided to us (right of data portability). Upon request, we will also pass the data on to a third party of your choice. You have the right to receive the data in a common file format. You can do this by sending a request by email to help@bucherer.com. Further contact information can be found under ’Contact’. Please note that we reserve the right to request proof of identity and that in the event of deletion of your data, use of our services will no longer be possible to the same degree or at all. Your consent to specific data processing can be revoked at any time. Please note that according to the law, specific data must be stored for a specific period of time. Such data must therefore remain with us until this period has expired. We block this data in our system and use it only in order to meet statutory requirements (see ‘Data retention’ below).

Data security

We take reasonable technical and organisational security measures that we deem appropriate in order to protect your stored data from being manipulated, fully or partially lost, or accessed by unauthorised third parties. Our security measures are adapted continually in line with technological developments. If you register with us as a customer, access to your customer account is possible only after entry of your personal password. You should treat your payment information as confidential at all times and close the browser window when you finish your communication with us, particularly if you are on a shared computer. We also take internal data privacy very seriously. Our employees and the service providers commissioned by us are obliged to maintain secrecy and comply with the provisions of data protection law. In addition, they are granted access to personal data only insofar as this is necessary.

Cookies

Among other things, cookies help to make your visits to our website simpler, more convenient and more meaningful. Cookies are information files that your web browser stores automatically on your computer’s hard drive when you visit our website. Cookies do not damage your computer’s hard drive or send your personal data to us. We use cookies, for example, in order to identify you as a registered user, so that you do not have to log in each time. This does not mean that we receive new personal data relating to you as an online visitor. Most internet browsers accept cookies automatically. However, your browser can be set up so that cookies are not stored on your computer or you receive a warning message when a new cookie is received. Further information can be found in your browser’s set-up options. However, deactivation of cookies may prevent you from using all the features of our portal.

Tracking tools

For the purposes of needs-based design and the continuous optimisation of our pages, we use the web analysis service Google Analytics from Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (‘Google’). In this respect, pseudonymised user profiles are created and small text files (‘cookies’) stored on your computer and used. Information generated by the cookie about your use of this website, such as

  • the browser type/version
  • the operating system used
  • the referrer URL (previous page visited)
  • the host name of the accessing computer (IP address)
  • the time of the server request
  • the device

is sent to servers of Google., a company of the holding company Alphabet Inc., in the US and stored there. As part of this, before this data is sent within the member states of the European Union or other states that are party to the agreement on the European Economic Area, the IP address is truncated through this website’s IP anonymisation (‘anonymizeIP’). The anonymised IP address transmitted by your browser in the context of Google Analytics is not consolidated with other data from Google. The entire IP address is sent to a Google server in the US and truncated there only in exceptional cases. In these case, we ensure by contractual means that Google observes a sufficient level of privacy protection. The information is used to analyse use of the website, to compile reports about website activities and to provide us with further services relating to website and internet use for the purposes of market research and needs-based design for these websites. This information is also forwarded to third parties where this is required by law or if third parties have been commissioned to process this data. Under the terms of Google, under no circumstances will the IP address be used in connection with other data relating to the user. Users can prevent Google’s collection of the data generated by the cookie that relates to a user’s use of the website (including their IP address) and Google’s processing of this data by downloading and installing the browser plug-in available via the following LINK As an alternative to the browser plug-in, users can prevent data collection by Google Analytics on the website in future by clicking on this link. By doing so, an opt-out cookie is stored on the user’s end device. To delete user cookies (see ‘Cookies’ above), the link must be clicked again. In order to manage cookies and pixels for tracking tools and other tools, we also use Google Tag Manager. The Tag Manager tool itself is a cookie-free domain and does not collect any personal data. Instead, the tool triggers other tags that may in turn collect data. If you have performed a deactivation at domain or cookie level, this remains in place for all tracking tags implemented using Google Tag Manager. For the sake of completeness, we note that as part of US legislation, the US authorities are able to take surveillance measures, under which the general storage of all data sent from the European Union to the US is possible. This takes place without distinction, limitation or exception, on the basis of the objective pursued and without objective criteria that would allow it to limit access by US authorities to personal data and its subsequent use to specific, strictly limited purposes that justify access to this data. For users residing in EU Member States, please note that, from the point of view of the European Union, the US does not have sufficient data protection levels due, inter alia, to the issues mentioned in this section. To the extent that we have explained in this privacy policy that recipients of data (such as Google) are located in the US, we will either based on a contract or by securing certification of these companies under the EU-US -Privacy Shield ensure that your data is protected at an appropriate level by our partners.

Social media functionalities

On our website, we provide certain social media functionalities, in particular the ability to share product information on Facebook, tweet product information, etc. The corresponding functionalities can be found on the individual product pages under ‘Share’. We provide you with social media functionalities for the following social networks:

  • Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, US,
  • Twitter Inc.,1355 Market Street, Suite 900, San Francisco, CA 94103, US,
  • Pinterest, Inc., 808 Brannan St, San Francisco, CA 94103, US,
  • Google+ of Google Inc.

If you click on the relevant social network symbol, you will be linked with the social network in order to use the functionality selected; e.g. in order to share content on Facebook or tweet on Twitter. However, you must log in to your corresponding user account or be logged in already. If you select one of the provided functionalities and click on the symbol for the corresponding social network, a direct connection is established between your browser and the server of the social network. The social network therefore receives the information that you have visited our website from your IP address and clicked on the link. If you click on a link to a social network while you are logged in to your account on the corresponding network, the content on our site may be linked to your social network profile, which means that the network may associate your visit to our website directly with your user account. If you would like to prevent this from happening, you should log out of any social networks before clicking on the corresponding links. An assignment will take place in any event if you log in to the network after clicking on the link.

Links to our social media pages

We have integrated links to our social media profiles on the following social networks into our website:

  • Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, US,
  • Instagram Inc., 1601 Willow Road, Menlo Park, California 94025, US,
  • Pinterest, Inc., 808 Brannan St, San Francisco, CA 94103, US,
  • YouTube, a service operated by Google.

If you click on the relevant social network symbols, you will be automatically taken to our profile on the network. In order to use the features of the network, you must log in to your user account for that network. If you click on a link to one of our social media profiles, a direct connection is established between your browser and the server of the social network.

Data retention

We only store personal data for as long as necessary,

  • to use the above-mentioned tracking, advertising and analysis services within the scope of our legitimate interest;
  • in order to carry out the above-mentioned services that you have requested or to which you have given your consent.
  • Contract data is kept longer by us, as this is required by statutory storage requirements. Retention requirements that oblige us to keep data arise from accounting and tax regulations. According to these regulations, business communications, closed contracts and accounting documents must be kept for up to 10 years. As far as we no longer need this data to carry out the services for you, the data will be blocked. This means that the data may then only be used for accounting and for tax purposes.
